Acceptance of Terms

By accessing or using Poqe, you agree to be bound by these Terms of Service and by any policies referenced in these terms, including the Poqe Privacy Policy. If you are using the app on behalf of another person or entity, you represent that you have the authority to accept these terms on their behalf.

Eligibility

You must be at least 13 years old, or the minimum age required to use the app under the laws of your jurisdiction, to use Poqe. If you are under the age of majority where you live, you should use the app only with the involvement of a parent or legal guardian.

License to Use the App

Subject to these terms, Poqe grants you a limited, non-exclusive, non-transferable, revocable license to install and use the app for your personal, lawful use on devices you own or control.

You may not:

• Reverse engineer, decompile, or attempt to extract the source code of the app except where applicable law clearly permits it.
• Use the app in a way that violates law, infringes another person's rights, or interferes with the app's normal operation.
• Remove copyright, trademark, or other proprietary notices.
• Use Poqe for abusive, fraudulent, or harmful conduct.

User Content

You retain ownership of the text, notes, emotional records, predictions, attachments, replies, exports, and other content you create in Poqe. You are solely responsible for that content and for the consequences of storing, exporting, backing up, or sharing it.

You represent that you have the rights necessary to create, store, or attach any content you put into the app and that doing so does not violate any law or third-party rights.

Acceptable Use

You agree not to use Poqe to:

• Create, store, or distribute unlawful, defamatory, infringing, exploitative, or malicious material.
• Transmit malware, disable device protections, or test the app in a way that harms the service, a device, or another person.
• Impersonate another person or misrepresent your affiliation with a person or organization.
• Use the app in violation of export controls, sanctions, or other applicable legal restrictions.

Local Storage, Exports, and Backups

Poqe is designed as a local-first app. In the current version, your core content is primarily stored on your device as part of normal app operation. You understand and agree that:

• You are responsible for managing your own backups if your content matters to you.
• Deleting the app, resetting the device, or losing device access may permanently remove locally stored content if no backup exists.
• Any exports you create may leave the app environment and may then be governed by the tools, storage providers, or services you choose to use.

Privacy

Your use of Poqe is also governed by the Poqe Privacy Policy, which explains how information is handled in connection with the app. By using Poqe, you acknowledge that you have read the Privacy Policy.

Intellectual Property

The app, its interface design, branding, visual assets, and related materials are owned by Poqe or its licensors and are protected by applicable intellectual property laws. Except for the rights expressly granted to you in these terms, no other rights are granted.

Disclaimers

Poqe is provided on an "as is" and "as available" basis to the fullest extent permitted by law. We do not guarantee that the app will always be uninterrupted, error-free, secure, or suitable for every purpose.

Poqe is a reflective productivity and journaling-style app. It is not a medical service, mental health service, crisis response service, legal service, financial advisory service, or emergency communications tool. Do not rely on the app as your sole record for critical or time-sensitive information.

Limitation of Liability

To the fullest extent permitted by law, Poqe and its affiliates, licensors, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, goodwill, profits, or device access arising out of or related to your use of, or inability to use, the app.

To the fullest extent permitted by law, the total liability of Poqe for any claim arising out of or relating to the app will not exceed the amount you paid, if any, for the app in the 12 months preceding the event giving rise to the claim.

Changes, Suspension, and Termination

We may modify these terms, suspend features, or discontinue the app at any time, subject to applicable law. If we make material changes to these terms, we may update the effective date and publish the revised version. Your continued use of Poqe after updated terms take effect means you accept the updated terms.

We may also suspend or terminate your right to use the app if you violate these terms or use the app in a way that creates legal or security risk.
